Personal Information Collection Statement

 

Purposes of Collection

1.

The Chinese Medicine Hospital of Hong Kong ("CMHHK") is a hospital operating under the control of the Government of the Hong Kong Special Administrative Region ("Government"), providing healthcare services to the public (whether Government subsidised or not) and/or other programmes/services operated and/or participated in by CMHHK (hereinafter referred to as "CMHHK Services"). In addition, the Government also provides a series of Government subsidised healthcare services and other related healthcare programmes and services ("Healthcare Services") to eligible Hong Kong residents through the Health Bureau (“HHB”) , the Primary Healthcare Commission (“PHCC”), the Department of Health (“DH”), and the Hospital Authority ("HA"). You are now applying for and/or registering to use the CMHHK Services, and may have previously applied for and/or registered to use the CMHHK Services, or may be currently receiving the CMHHK Services. To ensure the coordination and continuity of service provision, and to safeguard your interests, CMHHK is required to collect your personal data and health information, and may share these personal data and health information collected from you through the CMHHK Services with HHB, PHCC, DH, HA / other healthcare providers participating in the Healthcare Services (hereinafter referred to as "Other Healthcare Providers") and/or other relevant Government bureaux/departments.

Any information (including any information provided by you to CMHHK during the application and/or registration for the CMHHK Services, the receipt of the CMHHK Services, or in the relevant procedures, including personal data and/or health information) will be used by CMHHK for one or more of the following purposes (if applicable):

  (a)

processing the application, vetting information, and assessing your eligibility to apply for and/or register to participate in and/or use the CMHHK Services, including a verification procedure with the data kept by the Immigration Department, the Social Welfare Department, or other relevant Government bureaux/departments;

  (b)

administration, monitoring, auditing, and evaluation of the CMHHK Services and any other CMHHK Services you have participated in and/or used, including but not limited to processing of subsidy payment, providing personalised and necessary and continuous CMHHK Services, as well as the investigation of incidents and complaints and taking follow-up actions;

  (c)

promotion of healthcare system development, including development of primary care, service improvement, and enhancement of public health;

  (d)

statistical and research purposes;

  (e) other purposes directly related to any of the above stated purposes; and
  (f)

any other purposes as may be required, authorised, or permitted by law.

 

Classes of Transferees

The personal data and/or health information you provided may be transferred to and used by HHB / PHCC / DH/ HA and/or Other Healthcare Providers, and any other healthcare services you have participated in and operated/organised by HHB / PHCC / DH/ HA and/or Other Healthcare Providers. If required, CMHHK will disclose such personal data and/or health information to other parties for the purposes as stated in paragraphs 2(a) to 2(f) above, including:

  (a)

any personnel, agent, adviser, auditor, contractor, or service provider engaged by the operator of CMHHK to provide services or advice in connection with the purposes as stated in paragraphs 2(a) to 2(f) above;

  (b)

other relevant Government bureaux/departments to provide services or advice in connection with the purposes as stated in paragraphs 2(a) to 2(f) above; and

  (c) any person to whom CMHHK is required to make disclosure under any law or court order applicable in Hong Kong.

The personal data and/or health information you provided may be transferred to and used by HHB / PHCC / DH/ HA and/or Other Healthcare Providers for any of the following purposes (if applicable):

  (a)

processing the application, vetting information, and assessing your eligibility to participate in and/or use the Healthcare Services operated/organised by HHB / PHCC / DH/ HA and/or Other Healthcare Providers, including a verification procedure with the data kept by the Immigration Department, the Social Welfare Department, or other relevant Government bureaux/departments;

  (c)

  (e)

other purposes directly related to any of the above-stated purposes; and

  (f) any other purposes as may be required, authorised, or permitted by law.

 

Consent for Sharing of Personal Data and Health Information Collected by CMHHK and/or HHB / PHCC / DH/ HA / Other Healthcare Providers and/or other relevant Government bureaux/departments

5.

Consent is given by you or your parent/guardian on your behalf (as the case may be) to share your personal data and health information collected by these organisations across CMHHK and HHB / PHCC / DH/ HA / Other Healthcare Providers and/or other relevant Government bureaux/departments for the purposes of paragraphs 2(a) to 2(f) and 4(a) to 4(f).

 

Provide Sharing Consent

The provision of personal data and health information and consent for sharing personal data and health information are voluntary. However, if you, as an applicant and/or registrant for using the CMHHK Services and/or you are currently using the CMHHK Services, or as an applicant for and/or you are currently using the Healthcare Services, do not provide consent to the provision and sharing of personal data and health information, CMHHK / HHB / PHCC / DH/ HA and/or Other Healthcare Providers may not be able to process your application and/or registration, and/or may not be able to provide to you the CMHHK Services, and/or may not be able to provide to you the Healthcare Services operated/organised by HHB / PHCC / DH/ HA and/or Other Healthcare Providers, as appropriate. due to the absence of necessary information required to enable continuity of service provision to you.

 

Data Retention

CMHHK will retain your personal data only for as long as is necessary to fulfil the purposes for which it was collected, or as required to comply with applicable laws, regulations, and regulatory or operational requirements. Where applicable, personal data will be retained unless and until you submit a written request for the deletion of your account or personal data, subject to any legal or regulatory obligations requiring continued retention. Personal data retained may include, but is not limited to, your identity card number, name, email address, contact number, date of birth, and other information necessary for the purposes stated in this Statement.

 

Access to and Correction of Personal Data

You and your parent/guardian (where applicable) have a right to request access to and correction or deletion of your/his/her personal data (as the case may be) under sections 18 and 22 and Data Protection Principle 6, Schedule 1 of the Personal Data (Privacy) Ordinance (Cap. 486). A reasonable fee may be charged by CMHHK / HHB / PHCC / DH/ HA/ Other Healthcare Providers and/or other relevant Government bureaux/departments for processing any data access and/or correction request.

 

Revoke Sharing Consent

9.

You can revoke your sharing consent given to CMHHK / HHB / PHCC / DH/ HA / Other Healthcare Providers and/or other relevant Government bureaux/departments, and any other previously authorised party(ies) at any time. No fee shall be imposed for complying with a revocation request. However, you may not be able to apply and/or register for, and/or continue receiving the CMHHK Services provided by CMHHK, and/or the Healthcare Services operated/organised by HHB / PHCC / DH/ HA and/or Other Healthcare Providers, as appropriate. Upon revocation:

  (a)

The specified revoked party(ies) will no longer be allowed to access your personal data and health information provided to the relevant organisations during application and/or registration for the relevant services, receipt of the relevant services, or in the relevant procedures.

  (b)

Previously recorded personal data and health information will be retained and available for access by other authorised parties with your sharing consent.

Enquiries concerning the personal data and/or health information provided for the purposes aforementioned, including the making of access and correction or deletion requests should be addressed in writing to the Health Information and Records Office (HIRO) of CMHHK via email at: hiro@cmhhk.org.hk and /or other contacts provided by HHB / PHCC / DH/ HA / Other Healthcare Providers and/or other relevant Government bureaux/departments.
