Privacy Statement
The Chinese Medicine Hospital of Hong Kong (CMHHK) is committed to safeguarding the privacy of its patients and users. By registering for the services provided by CMHHK, including healthcare services and any other services operated by CMHHK, you acknowledge the collection and use of your personal data by CMHHK as outlined in this Statement. Please read this Privacy Statement carefully.
1. Information Collected
| 1.1 | To facilitate service bookings, CMHHK may collect personal data such as your full name (in Chinese and/or English), identity card number, date of birth, contact number, residential address, and email address (if applicable). You voluntarily provided the personal data to proceed with booking and/or payment. If the booking is made on behalf of another person, you must ensure that his or her consent has been obtained before submitting his or her personal data. |
| 1.2 | Upon arrival at CMHHK, your personal data may be collected again for registration. This will be verified against the personal data submitted during online booking and retained as part of your patient record. |
| 1.3 | As your healthcare provider, CMHHK may request additional personal data, including health information[1], or obtain such data from relevant third parties for medical care, treatment, and other healthcare-related services. |
[1] Means the data or information relating to the health condition of, or to the healthcare provided or to be provided to you.
2. Use of Information
| 2.1 |
Any information, including the personal data provided to CMHHK in connection with any application for enrolment or collected by CMHHK during your registration in the healthcare services provided by CMHHK, will be used by CMHHK for one or more of the following purposes (if applicable): |
| (a) |
processing the application, vetting information, and assessing the eligibility for enrolment in this healthcare service and any other healthcare service(s) operated by CMHHK, including a verification procedure with the data kept by the Immigration Department, Social Welfare Department or other Government departments; |

| (b) |
administration, monitoring, auditing and evaluation of this healthcare service and any other participating healthcare service(s) operated by CMHHK, including but not limited to processing of subsidy payment, providing personalised and necessary healthcare service, continuity of care and investigation of incidents and complaints; |
|
| (c) |
promotion of healthcare system development, including development of primary care, service improvement and enhancement of public health; |
|
| (d) |
statistical and research purposes; |
|
| (e) |
other purposes directly related to any of the above-stated purposes; and |
|
| (f) |
any other purposes as may be required, authorised or permitted by law. |
| 2.2 |
The Hong Kong Special Administrative Region of the People’s Republic of China (“Government”) is providing a series of Government-subsidised healthcare programmes/services operated by CMHHK, the Health Bureau (“HHB”), the Primary Healthcare Commission (“PHCC”), the Department of Health (“DH”) and the Hospital Authority (“HA”) to provide healthcare services to eligible Hong Kong residents. For the consideration of your application for or registration to the healthcare services provided by CMHHK (Government-subsidised or otherwise), coordination and continuity of care provision to you, it is essential and in your interest for your personal data, including but not limited to health information, collected by CMHHK to be shared across these parties. |
| 2.3 |
Where applicable data protection laws permit, CMHHK may use your personal data for direct marketing purposes, including sending information about health topics, service updates, or promotional materials. Where appropriate, such communications may be delivered by telephone, SMS, or multimedia messages. |
3. Disclosure of Information to Third Parties
| 3.1 |
The personal data which includes health information you provided may be transferred to and used by HHB/ PHCC/ DH/ HA which are directly involved in this healthcare service and any other participated healthcare service operated by CMHHK. Such personal data and/or health information may also be disclosed by HHB, PHCC, DH and/or HA to other parties for the purposes as stated in paragraph 2.1(a) to 2.1(f) and 2.2 above, if required, including: |
| (a) |
any personnel, agent, adviser, auditor, contractor or service provider engaged by HHB, PHCC, DH and/or HA to provide services or advice in connection with the purposes as stated in paragraph 2.1(a) to 2.1(f) and 2.2 above; and |
|
| (b) |
any person to whom HHB, PHCC, DH and/or HA are required to make disclosure under any law or court order applicable in Hong Kong. |
| 3.2 |
The personal data including health information you provided may be transferred to and used by HHB/ PHCC/ DH/ HA for any of the following purposes (if applicable): |
| (a) |
administration, monitoring, auditing and evaluation of your participated healthcare service(s) organised by HHB/ PHCC/ DH/ HA; |
|
| (b) |
coordination and continuity of care provision to you on your participated healthcare programme(s)/service(s) organised by HHB/ PHCC/ DH/ HA; |
|
| (c) |
promotion of healthcare system development, including development of primary care, service improvement and enhancement of public health; |
|
| (d) |
statistical and research purposes; |
|
| (e) |
other purposes directly related to any of the above-stated purposes; and |
|
| (f) |
any other purposes as may be required, authorised or permitted by law. |
| 3.3 |
Personal data may also be disclosed to law enforcement, regulatory bodies, or government authorities when required to comply with legal or regulatory obligations. |
| 3.4 |
By voluntarily providing your data, you are deemed to have consented to the disclosures outlined above. |
4. Consent for Sharing of Personal Data and Health Information from HHB/ PHCC/ DH/ HA
| 4.1 |
Consent is given by you or your parent/guardian on your behalf (as the case may be) to share your personal data and health information collected by HHB/ PHCC/ DH/ HA to CMHHK for paragraph 2.1(a) to 2.1(f) and 2.2. |
5. Provide Sharing Consent
| 5.1 |
The provision of personal data including health information and consent for sharing personal data are voluntary. However, if you, as an applicant to this healthcare service, do not provide consent to the provision and sharing of personal data including health information, CMHHK may not be able to process your application due to the absence of the necessary information required to enable continuity of care provision to you. |
6. Data Retention
| 6.1 |
CMHHK will retain your personal data for as long as necessary to fulfil the purposes for which it was collected, or to comply with applicable legal and regulatory requirements. Retained personal data may include, but is not limited to, your name, email address, contact number, and date of birth. |
7. Security of Personal Data
| 7.1 |
CMHHK takes appropriate steps to protect the personal data CMHHK holds against unauthorised or accidental access, processing, erasure, loss or use. |
8. Access and Correction of Personal Data
| 8.1 |
You can revoke your sharing consent given to CMHHK and any other previously authorised party(ies) at any time. No fee shall be imposed for complying with a revocation request. However, you may be withdrawn from this service under CMHHK. Upon revocation: |

You may request access to or correction of your personal data by submitting a written request to the Health Information and Medical Records Office (HIRO) at hiro@cmhhk.org.hk . |
9. Revoke Sharing Consent
| 9.1 |
You can revoke your sharing consent given to CMHHK and any other previously authorised party(ies) at any time. No fee shall be imposed for complying with a revocation request. However, you may be withdrawn from this service under CMHHK. Upon revocation: |
| (a) |
The specified revoked party(ies) will no longer be allowed to access your personal data and health information collected under this service; and |

| (b) |
Previously recorded personal data and health information will be retained and available for access by other authorised parties with this sharing consent. |
10. Transfer of Personal Data Outside Hong Kong
| 10.1 |
Where necessary, CMHHK may transfer your personal data to jurisdictions outside the Hong Kong Special Administrative Region for the original or directly related purposes for which the personal data was collected. All such transfers will be conducted in accordance with the Personal Data (Privacy) Ordinance of Hong Kong. |
11. Direct Marketing Communications

With your explicit consent, CMHHK may send you direct marketing materials and messages. You may opt out of receiving such communication at any time by addressing to hiro@cmhhk.org.hk. |
12. Privacy Statement Update

CMHHK reserves the right to revise or update this Privacy Statement anytime. Any changes will take effect immediately upon publication on the Website or the App. |
